Information automatically collected

In Short: Some information — such as your Internet Protocol (IP) address, browser and device characteristics, and application/device usage data — is collected automatically when you use our Services.

We automatically collect certain information when you visit, use, or navigate the Services. This information may include device and usage information, such as your IP address, browser and device characteristics, operating system, language preferences, referring URLs, device name, country, location, information about how and when you use our Services, information associated with your ISP or mobile service provider and your accounts associated with your service providers, information associated with your Apple App Store or Google Play Store accounts, the content you view, access or download, and other technical information regarding how you interact with our Services. This information is used, in part, to maintain the security and operation of our Services, and for our internal analytics, operational, business, and reporting purposes.

Like many businesses, we may also collect information through cookies and similar usage analytics technologies. We may use these analytics technologies assist us to personalize and provide a more convenient user experience to you, including assisting in your navigation of the Services and providing you with technical solutions; measure advertising and promotional effectiveness; analyze which features and sections you are using in the application(s) and provide content directly from us or third party content providers.

The information we collect includes:

Device Data. We automatically collect device information (such as your mobile device ID, model, and manufacturer), operating system, version information and system configuration information, device and application identification numbers, browser type and version, hardware model Internet service provider and/or mobile carrier, and Internet Protocol (IP) address (or proxy server) for the device you use to access the Services. If you are using our application(s), we may also collect information about the phone network associated with your mobile device, your mobile device’s operating system or platform, the type of mobile device you use, your mobile device’s unique device ID, and information about the features of our application(s) you accessed.

Log and Usage Data. Log and usage data is service-related, diagnostic, usage, and performance information our servers automatically collect when you access or use our Services and which we record in log files. Depending on how you interact with us and the permissions you give us through the application(s) preferences and settings, this log data may include your IP address, device information, browser type, and settings and information about your activity in the Services (such as the date/time stamps associated with your usage, pages, sections, and files viewed, searches, links you click on, items or files downloaded, and other actions you take such as which features you use), device event information (such as system activity, error reports and hardware settings).

Information collected from other sources

In Short: We may collect limited data from public databases, third party vendors, service providers, affiliates, governmental databases and other outside sources.

In order to provide the Services to you, provide you with accurate and up-to-date information regarding driver load, settlement, and payment status, and update our records, we may obtain information about you from other sources, such as our own internal records, files and databases, public databases, third party vendors, fleet owners with who you are contracted, government programs and databases, affiliate programs, data providers, and from other third parties. This information includes mailing/billing addresses, job titles, email addresses, phone numbers, intent data (or user behavior data), Internet Protocol (IP) addresses, dates of birth, driver safety scores, sensitive personal information such as 1099 and related tax information (including social security numbers), payment and settlement information for drivers, contractor/fleet owner information for users subcontracted with third party fleet owners, commercial driver’s license numbers and related information, driver insurance information and status, and driver medical cards.

Sensitive Personal Information

We do collect and use sensitive personal information in the course of providing the Services. This information includes tax information, social security numbers, and payment/settlement related information.

HOW DO WE PROCESS/USE YOUR INFORMATION?

In Short: We process and use your information to provide, improve, and administer our Services, communicate with you, for security and fraud prevention, and to comply with law. We may also process and use your information for other purposes with your consent.

We process your personal information for a variety of reasons, depending on how you interact with our Services, including:

To facilitate account creation and authentication and otherwise manage user accounts. We may process your information so you can create and log in to your account, as well as keep your account in working order.

To provide the Services to you, including administering, operating, and improving the Services.

To provide you with personalized information through our application(s) regarding your account, shipment, settlement, tax, safety, license, and driver authorization status.

To customize and personalize the Services, through user specific content, information, and personalized information.

To track user demographics, interests, and use of the Services.

To respond to user inquiries/offer support to users. We may process your information to respond to your inquiries or communications and solve any potential issues you might have with the requested service.

To send administrative information to you. We may process your information to send you details about our products and services, changes to our terms and policies, and other similar information.

To evaluate and improve our Services, products, marketing, and your experience. We may process your information when we believe it is necessary to identify usage trends, determine the effectiveness of our promotional campaigns, and to evaluate and improve our Services, products, marketing, and your experience.

To identify usage trends. We may process information about how you use our Services to better understand how they are being used so we can improve them.

To comply with our legal obligations. We may process your information to comply with our legal obligations, respond to legal requests, and exercise, establish, or defend our legal rights.

For our own marketing purposes. If you so choose and provide us with express opt-in consent, we may send you information about our or third-parties’ products and services. We may also send marketing emails to persons who have expressed an interest in purchasing our products or services, or whom we believe to otherwise be interested in such products or services. Disclosures to our Third-Party Vendors and Partners

We may engage third-party vendors and service providers to provide services in connection with our Services on our behalf. When we do use third party vendors, we disclose only the personal information that is necessary to deliver the service, and we have a contract in place that requires them to keep your information secure and not to use it for their own purposes. We require these vendors service providers to have access controls and other safeguards so that third parties only have appropriate access to achieve the intended business function.

We may share your information to the extent that we are required or permitted by law to do so. This may include complying with subpoenas and other legal processes, when necessary to enforce and protect our rights, including enforcing the terms of this Policy, responding to government requests or investigations, reporting unlawful activity, preventing and investigate fraud, and when necessary to protect the safety and security of our users.

Contractor Fleet Owners

To the extent you are a User of the Services engaged by the Company through a fleet owner with which you have contracted, we may share your information related to the loads, settlements, and driver information in connection with that fleet owner.

Subcontractor Drivers

If you are a User of the Services who is a fleet owner engaged by the Company with subcontracted drivers providing services on your behalf, with your express permission, we may share your information related to loads, settlements, payments, and other associated drive information related to your individual subcontractors. To the extent such subcontractor information sharing functionality is available, fleet owner users may choose to share or not share such information with their subcontractors at their discretion and choice.

Business Transfers and Transactions. We may share or transfer your information in connection with, or during negotiations of, any merger, sale of company assets, financing, or acquisition of all or a portion of our business to another company.

Affiliates. We may share your information with our affiliates, in which case we will require those affiliates to honor this privacy notice. Affiliates include our parent company and any subsidiaries, joint venture partners, or other companies that we control or that are under common control with us.

Marketing. We will not share your information with third parties for purposes of marketing the services or products of any third parties.

DO WE USE COOKIES AND OTHER TRACKING TECHNOLOGIES?

In Short: We may use cookies and other tracking technologies to collect and store your information.

We may use cookies and similar tracking technologies (like web beacons, webview, and pixels) to access or store information and to make our Services function appropriately. Our Services may use cookies or other similar analytics tools and technologies to enhance your experience while using our application(s) and remember your preferences. A cookie and similar technologies utilize a file containing an identifier, a string of numbers and letters or a graphic identifier, that is sent by a web server to a web browser/application and is stored by the web browser/application. This may include storage and retention of personal information for an unlimited duration of time so long as it is still being used in connection for the purposes for which it was collected.

When we have no ongoing legitimate business need to process or use your personal information for a purpose for which it was collected, we will either delete or anonymize such information, or, if this is not possible (for example, because your personal information has been stored in backup archives), then we will securely store your personal information and isolate it from any further processing until deletion is possible.

The Company permits users to access and request their personal data submitted through our website or applications. You may edit your personal information or change your privacy settings at any time either through the preference settings in our applications by emailing a request to the Company using the contact information below.

If you feel that personal information subject to this policy we have about you is incorrect or incomplete, you have the right to amend (through the privacy preference and user information settings in our application) or to ask us to amend your personal information. Your request for an amendment must be in writing, signed, and dated. It must specify the records you wish to amend, identify the global region, software, or tool that maintains those records, and give the reason for your request. You must address your request to the email questions@worldgrouplogistics.com .We will respond to you within 30 days. We may deny your request; if we do, we will tell you why and explain your options.

To delete information the Company maintains about you in accordance with this policy, please email the Company at questions@worldgrouplogistics.com. Such requests will be reviewed on a case-by-case basis and responded to within 30 days. The Company will work with you to delete your information when possible without disrupting the provision of Services.

Withdrawing your consent

If we are relying on your consent to process your personal information, which may be express and/or implied consent depending on the applicable law, you have the right to withdraw your consent at anytime. You can withdraw your consent at any time by contacting us by using the contact details provided in the section "HOW CAN YOU CONTACT US ABOUT THIS NOTICE?" below.

However, please note that this will not affect the lawfulness of the processing before its withdrawal, nor when applicable law allows, will it affect the processing of your personal information conducted in reliance on lawful processing grounds other than consent.

Changing Your Account Information

Upon your request to terminate your account, we will deactivate or delete your account and information from our active databases. However, we may retain some information in our files to prevent fraud, troubleshoot problems, assist with any investigations, enforce our legal terms and/or comply with applicable legal requirements.

CONTROLS FOR DO-NOT-TRACK FEATURES

Most web browsers and some mobile operating systems and mobile applications include a Do-Not-Track ("DNT") feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. At this stage no uniform technology standard for recognizing and implementing DNT signals has been finalized. As such, we do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online. If a standard for online tracking is adopted that we must follow in the future, we will inform you about that practice in a revised version of this privacy notice.

OTHER PRIVACY RIGHTS AND USER INFORMATION

Third party websites, links, and services

The Company is not responsible for the Privacy Policy of other websites or applications to which we may link and makes no representations whatsoever about other websites or applications other than those included in the Services, including websites or applications that may contain a link to, or information about us.

California Disclosures, Rights and Access

California law permits users who are California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes and to exercise certain data subject rights.

The Services are currently not made available to any residents of California as the Company does not engage or contract with any drivers who are residents of California. To the extent you become a resident of California while you are a user of the Services, please contact the Company at questions@worldgrouplogistics.com to determine the application of any California disclosure obligations or data subject rights to your information.

Age Requirements

Our Services are not directed to children under the age of 18, and children under the age of 18 are not eligible to use our Services. Protecting the privacy of children is important to us and we do not collect information from persons we actually know to be under 18 years of age. No part of our services is designed to be used by or to attract persons under 18 years of age. If we later learn that a child under the age of 18 has provided with their information through the Services, we will take steps to remove his or her information from our systems and servers and prevent the person from using the Services going forward.

International Users

Only legal U.S. residents currently residing in the United States are permitted to use the Services. Importantly, the Services are not available to any persons currently residing in the European or other persons subject to the EU’s General Data Privacy Regulation (“GDPR”). If you are using our Services from outside the United States, please be aware that you are sending information to the United States where our servers are located and that by using our Website and providing us with your data you are consenting to such a transfer. Information provided may then be transferred within the United States or back out of the United States to other countries outside of your country of residence, depending on the type of information. These countries (including the United States) may not necessarily have data protection laws as comprehensive or protective as those in your country of residence; however, our collection, storage, and use of your information will at all times continue to be governed by this Privacy Policy.

Authorized Users

The Services are available only to those authorized users who have contracted with us or one of our contracted fleet owners as a commercial truck driver and is subject to the requirements of your independent contractor agreement. The context in which your personal information is collected, processed/used, and shared in connection with the Services and under this Privacy Policy is a commercial and business context. Use of the Services in your personal or private capacity outside of your capacity as an independent contractor with us or one of our contracted fleet owners is not permitted and is beyond the scope of this Privacy Policy.
